Terms of Service
Effective date: October 26, 2026
Last updated: October 30, 2026
These Terms of Service ("Terms") are an agreement between you and dhailabs ("dhailabs", "we", "us"). They cover your use of dhailabs.com and products and services we may offer (together, the "Services").
By using the Services, or by signing in to Kin, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
Please read Section 16 carefully. If you live in the United States, it requires disputes to be resolved by individual binding arbitration, not in court or as a class action, unless you opt out within 30 days. Section 16 does not apply to consumers in the EEA, the UK, Switzerland, or anywhere else where it is not allowed.
1. Who can use the Services
- dhailabs.com is a general company website. It has no age requirement of its own; the rules below apply to our products.
- Kin:
- You must be at least 18 to create or host a board, including becoming host when a board is handed over.
- You must be at least 13 to sign in to Kin and join a board as a member. Where local law sets a higher age of digital consent for this kind of service (for example, up to 16 in some EU countries), that higher age applies to joining.
- If you are between 13 and 17 (or under the age of majority where you live), you may join a board only with the permission of your parent or guardian where the law requires it, and your parent or guardian should review these Terms with you.
- Children under 13 may not use Kin, sign in, or claim a card. A host may still add a card about a child as information about a family member who is not a user (Section 5).
- How Kin checks age. Creating a board requires you to confirm you are 18 or older. Accepting an invite requires you to confirm you are 13 or older. When you claim a card, Kin also checks your age from the date of birth on that card: if it shows you are under 13, the claim is refused, and if it shows you are under 18, you cannot host. Existing hosts are asked to confirm they are 18 or older once, at their next host action. These checks are enforced by our server.
- Work: you must be at least 18.
You must also not be barred from using the Services under applicable law. If you use the Services for an organization, you confirm that you can accept these Terms for it.
2. Our products
- Kin is a private family whiteboard. You can create boards, add people and relationships, and invite family members by email address. Kin is in beta and is currently free.
- Work is software for managing the full lifecycle of a company's people and teams. It is in early access and has no app yet. Emailing us about early access does not create an account, start a subscription, or promise a launch date or features. When Work or any other new product launches, we will add any terms specific to it to these Terms. There is one set of Terms for all of dhailabs.
Access to Work data by dhailabs staff. By agreeing to these Terms on behalf of your company, you agree that authorized dhailabs staff, limited to our customer care and product teams, may access your company's data in Work when needed to provide support, keep the Services secure and working, and fix problems. Access is limited to people who need it for those purposes, is bound by confidentiality, and is logged. To improve our products and services, we use your company's data only in aggregated or de-identified form, unless you agree otherwise. We never sell your company's data or use it for advertising.
3. Your Kin account
- You sign in to Kin with a Google account (other sign-in methods may be added later). Keep that account secure: anyone who can sign in to it can use your Kin boards. Tell us right away at [email protected] if you think your account has been misused.
- You are responsible for what happens under your account.
- Give accurate information when you confirm which card on a board is you. Do not claim a card that is not you, or try to guess someone else's details.
4. Boards, hosts, and members
- The person who starts a board is its host, and must be at least 18 (Section 1). The host manages the board: only the host can invite people (except the host invitation below), revoke invites, remove members, confirm or unlink which card belongs to which member, add, change, and see dates of birth and birth years on cards nobody has ever claimed (and show such a birth year to the family only if the card is an adult's), and delete or restore the board. Birth years and dates of birth are hidden by default. Once a person claims a card with their Google account, only they can change its date of birth and birth year, and only if they are 18 or older can they choose to show them to the board. They stay private to them even if the card is later unclaimed. A host can leave a board that has other members, which hands the host role over (Section 11). A host who is the only member can only delete the board.
- Boards without a host. If the host role ends and no member is eligible to become host, the board is not deleted. It stays without a host. Members keep access to the board and to their own information, but host-only actions (inviting, removing members, managing dates of birth on cards nobody has ever claimed, and deleting or restoring the board) are unavailable until a new host takes over. The Privacy Policy's rules, including private dates of birth on claimed cards, still apply.
- Inviting a new host. On a board without a host, and only then, any member aged 13 or older can invite an adult to become host. Members aged 13 to 17 can send only this invitation. Host invitations are never accepted automatically and become void once the board has a host. By sending it, you confirm that you are allowed to share the invitee's email address with dhailabs for this purpose. The invitee must confirm they are 18 or older when accepting, and then becomes host.
- Hosting is not ownership. A board brings together information from many people. The host does not own the board, the information other people contribute, or the information about other people on it. Like every member, the host keeps their rights in their own contributions (see Section 5).
- Members the host invites must be at least 13 (or the higher local age in Section 1). Members can view and edit the board and can leave it at any time. When a member leaves, their card and its links are hidden and kept until they are invited again and rejoin, or delete their account. Invite only people you trust with your family's information.
- Kin has usage limits, which today include up to 10 hosted boards per account, up to 25 invites at a time and 100 pending invites per board, and a maximum board size. We may change limits, and we will try to give notice before we lower them.
5. Your content
- You keep your rights. You keep whatever rights you have in what you contribute to a board (names, dates, notes, relationships, and so on) and in your own personal information. Nobody, including the board host and dhailabs, becomes the owner of it because it is on a board. Information about a person remains that person's personal information, whoever entered it.
- Permission you give us. You give dhailabs a non-exclusive, worldwide, royalty-free permission to host, store, copy, process, and display your content only as needed to run the Services for you and the people on your boards, to keep them secure, and as described in the Privacy Policy. This permission ends when your content is deleted from the Services, except for copies in backups that expire on their normal schedule.
- Permission you give the host and members. By adding content to a board, you let that board's host and members view and edit it on the board, and you let the host manage it (for example by deleting cards, removing members, or deleting the board) using Kin's features. This does not give them ownership of your content or the right to use it outside the board.
- Boards are shared spaces. Content on a board is shared with its host and members. If you leave a board or delete your account, content you added to a board that other people still use (for example cards you created) stays on that board, as described in Section 11 and in the Privacy Policy.
- Information about other people. Kin boards usually contain information about other people, including relatives and children. You may add information about another person only if you have the right to share it with the people on the board. Respect their wishes: if someone asks you to change or remove information about them, or about their child, please do so. Do not add sensitive information about others (such as health, religion, sexual orientation, or immigration status) without their permission.
- Children. Children under 13 cannot have Kin accounts or claim cards, and members aged 13 to 17 are subject to the rules in Section 1. A host may add a card about a child as information about someone who is not a user. If you add information about a child, you confirm that you are the child's parent or guardian or have their parent's or guardian's permission. Do not invite a child under 13 to a board.
- Shared editing. Members can change or delete content on boards they belong to. Keep your own copy of anything important (Kin lets you download a printable copy of a board). Printed or saved copies are outside Kin's control, and deleting a board or account does not delete them.
6. Acceptable use
You agree not to:
- break the law or help anyone else break it;
- harass, threaten, impersonate, or harm anyone, or use Kin to stalk or track people;
- add other people's private information without a right to do so, or use Kin to collect information about people for marketing, background checks, or similar purposes;
- try to access boards, accounts, or data that are not yours, or get around our security, rate limits, or verification;
- upload malware, or probe, scan, overload, or disrupt the Services;
- scrape the Services or use automated tools to access them except through features we provide; or
- resell the Services or use them to build a competing product.
We may remove content or suspend or close accounts that break these Terms, put others at risk, or expose us to legal liability. Where reasonable we will tell you first and give you a chance to download a copy of your data.
7. Our property and feedback
The Services, including the software, design, and the dhailabs, Kin, and Work names and logos, belong to dhailabs and its licensors. These Terms do not give you any rights to them except to use the Services as allowed here. If you send us feedback or ideas, we may use them without any obligation to you.
8. Third-party services
Kin relies on third-party services, including Google Sign-In and Cloudflare hosting. Your use of your Google account is also governed by Google's terms. We are not responsible for third-party services we do not control.
9. Fees
Kin is currently free. If we introduce paid plans or features, we will show you the price, billing period, renewal, cancellation, and refund terms before you buy. You will not be charged without agreeing first, and existing free features will not start costing money without at least 30 days' notice.
10. Beta, changes, and availability
Kin is in beta. Features may change, be added, or be removed, and the service may sometimes be unavailable or have bugs. We may change or stop any part of the Services. If we shut down Kin, we will give at least 30 days' notice by email or in the app where possible so you can download copies of your boards.
11. Deleting boards and ending your account
- A host can delete a board at any time. It stays read-only and restorable for 30 days and is then permanently deleted.
- You can stop using the Services at any time. You can delete your account in Kin (you type DELETE to confirm), or email [email protected] from the email address on your account; we handle email requests within 30 days. Deleting your account is permanent and cannot be undone. Download a copy of any boards you want to keep first.
- You can pause your account instead of deleting it. While paused, you cannot use your boards, and on boards you host, host-only actions wait until you resume. When you pause, you choose whether your card stays visible or is hidden until you resume. When you delete your account, you choose whether to keep your card as an unclaimed card or remove it. If you keep it, it stays on the board as an unclaimed card; its date of birth, age, and birth year are deleted and hidden from everyone, including the host, even if you had chosen to show them, and nobody can add the old values back. The card stays locked, with no date of birth or birth year: the host cannot attach a new invite to it or link it to anyone, and nobody can claim it. If an invite was already linked to the card, the person who accepts it joins the board without the card. If you remove it, the whole card, including its birth year, is kept hidden for 30 days and then permanently deleted.
- When your account is deleted, boards you host that have other members are kept for those members, and the host role passes to another member. If you name a member, they have 48 hours to accept and confirm they are 18 or older. If you name no one, or they decline or do not answer, it passes automatically to the earliest-joined member who has confirmed they are 18 or older, whose card's date of birth does not show them as under 18, and who has not declined. If no member is eligible, the board is not deleted. It stays without a host (Section 4). The same handover applies when a host leaves a board. Boards you host with no other members move to Recently deleted for 30 days and are then permanently deleted. The Privacy Policy (Section 9) explains this in detail.
- We may suspend or end your access as described in Section 6. Sections 5, 7, and 12–18 continue after your account ends.
12. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT ALLOWED BY LAW, dhailabs DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not promise that the Services will be uninterrupted, error-free, or secure, or that content will never be lost. Kin is a tool for organizing family information you provide; we do not check that information for accuracy, and it is not a genealogical, legal, or official record.
13. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, dhailabs WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM OR US $50. Some places do not allow these limits, so they may not fully apply to you. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be limited by law.
14. Indemnity
To the extent allowed by law, you agree to defend and compensate dhailabs for claims, losses, and costs (including reasonable legal fees) arising from your content, including information you add about other people, or from your breach of these Terms. This section does not apply to consumers where local law does not allow it.
15. Governing law and courts
These Terms, and any dispute about them or the Services, are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws rules. The Federal Arbitration Act governs Section 16.
Subject to Section 16, any dispute that is not arbitrated will be decided only in the state or federal courts located in New York County, New York, and you and we consent to those courts' jurisdiction.
Consumers outside the United States. If you are a consumer in the EEA, the UK, Switzerland, or another country whose laws give you this right, you keep the protection of the mandatory laws of the country where you live, and you may bring proceedings in the courts there.
16. Arbitration and class-action waiver (United States)
This Section 16 applies only if you live in the United States, and only where the law allows it. It does not apply to consumers in the EEA, the UK, or Switzerland, or anywhere else where pre-dispute arbitration agreements or class-action waivers with consumers are prohibited.
- Try to resolve it informally first. Before starting an arbitration or small-claims case, send a written notice describing your claim and the relief you want to [email protected] (we will send ours to the email address on your account). Both sides will try in good faith to resolve the dispute for 60 days after the notice is received.
- Binding individual arbitration. If it is not resolved, any dispute, claim, or controversy between you and dhailabs arising from or relating to these Terms or the Services will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect (adr.org), before a single arbitrator. The arbitrator decides all questions about whether a dispute must be arbitrated, except as stated in item 5. Fees are paid as set out in the AAA's Consumer rules and fee schedule. The arbitration may be held by video or phone, on written submissions, or in person in the county where you live or another place we agree on. The arbitrator may award the same individual relief a court could, and must follow these Terms.
- Exceptions. Either side may (a) bring an individual claim in small-claims court if it qualifies and stays there, and (b) ask a court for an injunction to stop infringement or misuse of intellectual property or unauthorized access to the Services.
- Class-action waiver. You and dhailabs may bring claims against each other only individually, not as a plaintiff or class member in any class, collective, consolidated, or representative action. The arbitrator may not combine more than one person's claims and may award relief only to the individual party asking for it.
- If the waiver fails. If the class-action waiver in item 4 is found unenforceable for a particular claim or remedy, that claim or remedy (and only that one) will be decided in the courts named in Section 15, after all other claims are arbitrated, and not in arbitration.
- Your right to opt out. You can opt out of this Section 16 by emailing [email protected] within 30 days after you first accept these Terms, from the email address on your account, with the subject "Arbitration opt-out", your name, and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms, and disputes will then be decided in the courts named in Section 15.
- Changes to this section. If we make a material change to this Section 16, it will not apply to a dispute we already had notice of, and you may reject the change by emailing us within 30 days of the change taking effect.
- Jury waiver. If a dispute goes to court rather than arbitration, you and we waive any right to a jury trial, to the extent allowed by law.
17. Changes to these Terms
We may update these Terms. We will post the new version here with a new effective date. If a change is material, we will give reasonable notice (at least 30 days where possible) in Kin or by email before it takes effect. If you keep using the Services after that, you accept the updated Terms. If you do not agree, stop using the Services and ask us to delete your account.
18. General
- Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Services.
- Severability and waiver. If part of these Terms is unenforceable, the rest stays in effect (except as stated in Section 16.5). Not enforcing a term is not a waiver of it.
- Assignment. You may not transfer these Terms without our consent. We may transfer them as part of a reorganization, merger, or sale of dhailabs or a product.
- Consumer rights. If you are a consumer, nothing in these Terms takes away rights you have under the mandatory laws of where you live.
